By accessing or using the Chingu mobile application ("App"), website at getchingu.com ("Site"), or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
The Service is operated by MangoLab ("we," "us," or "our"), located at 339 An Hai, Son Tra, Da Nang, Vietnam 550000.
You must be at least 17 years of age to use the Service. By using the Service, you represent and warrant that you are at least 17 years old. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We do not knowingly collect personal information from anyone under 17. If we learn that a user is under 17, we will promptly delete their account and associated data.
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
You may not share your account with others or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these Terms.
Chingu offers a free tier and a paid subscription plan ("Chingu+").
Chingu+ subscriptions are billed on a recurring basis (monthly or annually) through the Apple App Store or Google Play Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
Refunds are handled by the respective app store in accordance with their refund policies. We do not process payments directly and cannot issue refunds outside of the app store process.
You retain ownership of the text, voice recordings, and other content you submit through the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store your User Content solely for the purpose of operating, improving, and providing the Service to you.
You represent that you have the right to submit all User Content and that your content does not violate any third-party rights or applicable laws.
The Service uses artificial intelligence to generate responses from virtual AI companions. AI-generated content may be inaccurate, incomplete, or inappropriate. You acknowledge and agree that:
The Service is designed for language learning and entertainment purposes only. It is not a substitute for professional medical advice, diagnosis, treatment, mental health services, therapy, or counseling. If you are experiencing a mental health crisis, please contact your local emergency services or a licensed mental health professional.
We make no representations or warranties that the Service will provide any therapeutic, emotional, or health-related benefit.
The Service, including its design, features, AI models, companion characters, character artwork, text, graphics, logos, and software, is owned by MangoLab and protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on any part of the Service without our prior written consent.
The Chingu name, logo, and all companion character names and likenesses are trademarks of MangoLab.

By using voice features, you consent to the transmission of your audio data to our third-party service providers for processing as described above and in our Privacy Policy.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

You may delete your account at any time through the App settings. Upon account deletion, we will delete your personal data within 30 days, except where retention is required by law or for legitimate business purposes.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violations of these Terms, fraudulent activity, or prolonged inactivity.
Upon termination, your right to use the Service ceases immediately. Any active subscription will remain valid until the end of the current billing period, but will not renew.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY AI-GENERATED CONTENT, LANGUAGE CORRECTIONS, OR TRANSLATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MANGOLAB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS (US$100), WHICHEVER IS GREATER.
These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively by the competent courts of Da Nang, Vietnam.
Before initiating any legal proceeding, you agree to first contact us at minoerick120@gmail.com to attempt to resolve the dispute informally. We will make reasonable efforts to resolve any dispute within 30 days of receiving your notice.
We may update these Terms from time to time. When we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
We encourage you to review these Terms periodically. The "Effective Date" at the top of this page indicates when these Terms were last updated.
